Summary Judgment Obtained For Mexican Resort Based On Lack Of Duty To Plaintiff

 
Plaintiff filed suit in the United States after he fell on an allegedly defective staircase at a resort located in Mexico. The Plaintiff argued for liability against Josh Yeager’s client based upon a piercing the corporate veil theory – arguing that Josh’s client should be held liable because it advertised and marketed the subject resort in the United States. The court rejected the Plaintiff’s arguments and Josh obtained summary judgment on behalf of his client by arguing that his client owed no duty to the Plaintiff because it did not own, operate, manage, or otherwise control the subject resort.
