A Plaintiff filed suit in a U.S. federal court after he allegedly became ill from eating food served at an all-inclusive resort located in the Dominican Republic. Josh Yeager obtained a dismissal on behalf of the resort owner by arguing that the U.S. federal court could not constitutionally assert personal jurisdiction over the resort owner. The Plaintiff argued that the resort placed advertisements in the Plaintiff’s home state and that the resort had a website accessible to U.S. residents. The federal court rejected those arguments and instead dismissed Mr. Yeager’s client due to lack of personal jurisdiction.
