Strength Of Motion For Summary Judgment Motion Leads To Reasonable Settlement

 
Josh Yeager defended a general contractor in a wrongful death lawsuit brought on behalf of an employee of an elevator subcontractor after he was electrocuted while performing work on an elevator during the renovation of a commercial building. Josh filed a motion for summary judgment after developing evidence during discovery showing that the general contractor did not control the means and methods or the operative details of the subcontractor’s work. While the parties were waiting for the court to rule on the motion for summary judgment, Josh was able to negotiate a very reasonable settlement based on the strength of the pending motion.
