Josh Yeager was a key member of the legal team that brought a breach of contract and fraud lawsuit on behalf of a machine manufacturer located in Austria. The suit was litigated in federal court against two U.S. companies that entered into an exclusive contract with the Austrian manufacturer, agreeing to purchase a significant number of machines over a five year period. Discovery in the case uncovered evidence showing that the Defendants never intended to honor the purchase requirements of the long-term exclusive contract, but instead entered into the contract for the purpose of precluding the Austrian manufacturer from entering the U.S. market and/or partnering with any of the Defendants’ competitors. The amount of the settlement is confidential, but it is fair to say that Josh’s client was very happy with the settlement that was reached in the case.
