Germany More Convenient Forum For Wrongful Death Claim Arising From Accident In Ansbach, Germany

A wrongful death suit arising from an accident in Germany was filed in federal court in Chicago. The defendant driver and the decedent were both U.S. Citizens stationed in Germany. Ed Siegert was successful in obtaining a dismissal of the case in Illinois based upon the doctrine of forum non conveniens, arguing that the suit should have been brought in Germany. German law allowed only the recovery of funeral expenses under the facts of this case, and plaintiff elected not to proceed in the German courts after the case was dismissed in Illinois. (Martin v. Vogler, 1993 WL 462853 (N.D. Ill. 1993). (Click here for PDF version of the court’s opinion.)
