Mexican Law Applied To Personal Injury Suit Filed In Chicago

Ed Siegert successfully argued for the application of Mexican law and obtained summary judgment on behalf of his client in a personal injury lawsuit filed by an Illinois dentist seriously injured in a fall into a mechanical pit while on vacation at a hotel property located in Acapulco, Mexico. The summary judgment was affirmed by the Seventh Circuit, finding the diversity action was governed by the law of Mexico, under which contributory negligence was a complete defense. (Spinozzi v. ITT Sheraton, 174 F3d 842 (7th Cir. 1999). (Click here for PDF version of the court’s opinion.)
