Summary Judgment Obtained For Roofing Products Manufacturing Company After 20 Foot Fall From A Roof

In Beyers v. Hutchinson, Inc. et al, Brian Shaughnessy represented a lumber company that manufactured roofing products including purlins used as braces on roofs. It was alleged that our client's products were used in the construction of the roof of a pole barn. The incident occurred when defective purlins failed to support the plaintiff who was installing the roof. Mr. Beyers fell 20 feet to the ground and sustained serious and permanent personal injuries. It was alleged by plaintiff that our client manufactured the defective purlins. There was evidence that Hutchinson Inc. sold purlins to the general contractor of the project and in fact delivered the product to the job site. After numerous discovery depositions, including plaintiff's liability expert, we were able to show that our client did not manufacture the defective purlins and prevailed on our motion for summary judgment. The case was ultimately settled by the remaining defendants for over $2 million.
