Defense Of Property Manager In The Hancock Scaffolding Incident Involving Seven Lawsuits, Multiple Deaths And Significant Injuries

 
Demo et al v. Sudler and Company et al concerned the events of March 9, 2002 when a 100 foot scaffold fell in high winds from the 47th floor of the John Hancock Building located on Michigan Avenue in the heart of Chicago's Magnificent Mile. The scaffold fell to the street below crushing automobiles resulting in the deaths of occupants of motor vehicles and serious injuries to pedestrians. Seven lawsuits were consolidated. The scaffold was on the building in conjunction with a repair project at the Hancock Building. Plaintiffs sued, among others, the contractor that designed the scaffold, architects, building security company and property manager of the commercial portion of the building. Brian Shaughnessy represented the property manager of the residential portion of the building. It was alleged by plaintiffs that our client was responsible for supervising the project including directing where the scaffold was to be "parked" during off hours and during inclement weather. Discovery in the case included thousands of pages of documents and many depositions of the parties, liability experts and medical experts. One of the keys to our defense was the deposition of our client's representative, who, after two days of preparation, handled the deposition interrogation extremely well. The consolidated lawsuits ultimately settled for $77,000,000. Our success in defending the case is evidenced by the fact that our client's contribution to the settlement was just $200,000.
