Summary Judgment and Dismissal Granted in Common Law Fraud and Strict Liability Action

Plaintiff filed suit against Defendant pursuant to theories of strict liability and common law fraud. Ms. Milos argued that the strict liability count was subject to dismissal because the Moorman doctrine barred Plaintiff from recovering economic losses. The court agreed and dismissed the strict liability claim. Thereafter, Ms. Milos filed a motion for summary judgment, asserting that the assignment that formed the basis of the common law fraud count was void. The trial court agreed and granted summary judgment in favor of Defendant. Boiko v. Norvey, et al., 05 L 14649.
