Summary Judgment In Warehouse Fire Case

Attorney
John P. Lynch Jr.

Practice Area
Subrogation Recovery

John Lynch represented the defendant installer of a racking/shelving system at a large storage facility. A fire caused extensive damage to the facility and the personal property and documents contained in it. Various parties whose property was lost or destroyed in the fire filed an action against multiple entities including the installer of the racking system. Damages were claimed to be in the area of $100,000,000. The installer obtained summary judgment on the basis that it followed the plans and specifications provided to it to accomplish the installation and there was no proximate cause connecting the shelving system to the fire. This decision was affirmed on appeal. Altheimer & Grey, et. al., v. Brambles, Inc.
