Summary Judgment For Political Candidate In Defamation Action Filed by Sitting Sheriff

John Lynch represented a political candidate who was sued for defamation for allegedly publishing a flyer that portrayed his opponent, the sitting DuPage County Sheriff, in a negative light. The flyer appeared in 18,000 newspapers the day before the election. After discovery, summary judgment was awarded to the defendant. The court found that his conduct in publishing the flyer to his advisors only was not done with malice and, in any event, the flyer was not defamatory. Zaruba v. Connell.
